Web site usage.
1) Use of this web site means that you agree to be bound by
the site’s T&Cs. If you do not agree to the Terms
and Conditions of use, you must not use this site.
2) Pistachio reserves ownership of copyright on all items
featured on its web site including design, text, layout, graphics,
coding and the selection and arrangement of items included
on the site. In particular all photos used on the web site
are copyright of Pistachio and may not be used for any purpose
without written permission from Pistachio. Permission is given
to copy or print from this site for the sole purpose of placing
an order with Pistachio and for using the site as a shopping
and catalogue resource. Any other usage whatsoever without
prior written permission from Pistachio is strictly prohibited.
3) Pistachio reserves the right to change, modify, substitute
or remove, without notice, any information on this site, as
deemed necessary by Pistachio.
4) This site may provide links to other websites not related
to Pistachio. The content of any such sites is not under our
control; accordingly we do not accept any responsibility or
liability for the content of these sites. Neither do these
links signify endorsement of these sites in any way whatsoever.
5) Access to this site and the materials within are supplied
free of charge. Whilst we will use our best endeavours to
ensure availability of access, we cannot guarantee and do
not warrant that you will have continuous access to this site.
Neither do we warrant that the site shall be free from viruses
or other harmful components.
6) You shall not cause any nuisance, annoyance or inconvenience
to us, our customers or our users of the site.
Payment.
1) Payment Terms strictly 30 days from date of issue of invoice.
2) Account customers failing to settle within 30 days may
have their account put onto a Pro forma basis until such time
as Pistachio feels appropriate.
3) Ownership of all items supplied remains with Pistachio
until payment is received.
4) Queries with regard to items supplied against invoice should
be notified to Pistachio immediately on receipt of goods.
5) New customers will be invoiced on a pro forma basis until
such time as we have been able to establish the credit standing
of the customer such that we may be able to offer them our
standard 30 days terms.
6) New customers grant Pistachio permission to make all appropriate
credit checks and to ask for trade references prior to offering
our standard 30 days terms of payment.
7) Pistachio reserve the right to recover all costs incurred
in the collection of invoices outstanding beyond 30 days.
Interest and costs will be applied at the statutory rate specified
by the Ammended Late Payment of Commercial Debts (Interest)
Act 1988.
8) Pistachio has assigned all rights in its invoices to Lloyds
TSB Commercial Finance to whom all payments should be sent.
All cheques should be
made payable to “Lloyds TSB Commercial Finance”
and should be sent to No1, Brookhill Way, Banbury, Oxon, OX16
3EL. Payment by credit card may be made direct to Pistachio.
An administration charge of 3% will be added to all invoices
settled by credit card.
Delivery.
1) All items supplied by Pistachio will be sent on a signed
for basis, in the UK this being Royal Mail Special Delivery
or Recorded Delivery.
2) Pistachio will apply P&P costs to all deliveries whose
total value is less than £700. Deliveries above £700
will be sent free of P&P costs.

4) Goods will only be despatched to non-account customers
on receipt of payment.
Returns
1) All items returned to Pistachio should be sent by “signed
for” delivery such as Royal Mail Recorded Delivery.
Proof of posting will not be accepted as proof of delivery.
2) Pistachio will not accept items for return which are more
than 6 months from invoice date.
3) Items which have been damaged through misuse will not be
considered for return.
4) Items for return should be securely packaged with a clear
description as to the nature of the fault.
5) Pistachio may at its own election, repair, replace or issue
a credit note against items accepted for return. Credit notes
will be issued against Items no longer available.

Sales
1) Pistachio does not operate a sale or return policy. All
items are sold on a firm sale basis. A signature is required
on our sales forms and a copy is left for your records. The
order constitutes a legally binding contract between yourself
and Pistachio. Similarly items purchased from the web site
are on a firm sale basis.
2) Owing to the volatile nature of silver prices and international
exchange rates, Pistachio reserves the right to, at its election,
change product prices as it sees fit. These charges will not
be applied to pre existing orders.
3) Pistachio reserves the right to supply orders on a partial
fulfilment basis unless explicitly asked not to do so. Completion
of the order will follow as soon as practicable. Pistachio
does not charge postage on secondary deliveries.
4) Initial orders placed on the web site, by new clients,
shall be for a total value of not less than £500. All
future orders and orders by established clients are not subject
to a minimum order value. Subject to 23 above, all items will
be subject to a P&P fee which we shall endeavour to hold
at cost.
5) All items are offered subject to availability at the time
of delivery of the order. As many items are produced on a
limited basis for seasonal supply, customers should bare this
in mind when requesting delayed delivery.
General
1) All items supplied by Pistachio are produced using 925
Sterling Silver, are stamped by The Edinburgh Assay Office
and comply with all UK Assay legislation. The Edinburgh Assay
office is at Goldsmiths Hall, 24 Broughton St, Edinburgh,
EH1 3RH. Tel; 0131 556 1144.
2) Item 28 above not withstanding, Pistachio does not guarantee
the total absence of nickel or other components in its products
and does not accept any liability for allergic reactions known
or unknown to any of its products.
3) Pistachio take every care to portray and describe items
accurately, however as many of the items supplied by Pistachio
are hand made, individual variations may occur. Pistachio
can not guarantee that items supplied will be absolutely identical
to items previously supplied or items demonstrated by our
agents. Pistachio will use its best endeavours to ensure that
items supplied match product descriptions. Not withstanding
the above, no representation or warranty is given as to the
accuracy or completeness of information given. In particular
customers using the web site to order product should note
that due to colour disparities between different computer
screens there may be perceived colour variations between items
shown on the web site and those supplied.
4) Pistachio reserves the right to alter packaging specification
as it sees fit.
5) Credit card processing facilities for www.pistachio-wholesale.co.uk
are supplied by Lloyds TSB Cardnet.
6) Queries and problems through use of the web site, should
in the first instance be put to Pistachio, if you are not
happy with the response you should contact you credit card
provider.
Law
1) The terms and conditions and all disclaimers and other
materials on this site shall be governed by and construed
in accordance with English law and all disputes shall be referred
to the exclusive jurisdiction of the English courts to which
all parties shall submit.
2) Except in relation to liability for death or personal injury,
for which no limit applies, the liability of Pistachio for
direct loss arising out of the use of this web site, whether
based on contract, tort, strict liability or otherwise, is
limited to the total value of the transaction under which
the claim arises. In no event shall Pistachio be liable for
any consequential loss whatsoever arising out of use of this
site.
3) Any failure by us to exercise or enforce any right or provision
of the Terms shall not constitute a waiver of such right or
provision.
4) If any provision included herein, in whole or part,shall
be found to be invalid or unenforceable,(by a court or other
such competent body), the validity of the other provisions
of these terms shall not be affected.
5) Pistachio reserves the right to vary the Terms from time
to time as it sees fit. Such variations shall become effective
immediately upon posting to the site and by continuing to
use the site; you shall be deemed to accept any such variations.
